TERMS AND CONDITIONS
Terms:
Net thirty days on established accounts. An account may be put on hold until brought up to date.
Credit Policy:
We require three trade references and the name of your bank to open a new account. Allow ten days for processing. If delivery is required before references can be checked, we accept Visa, Mastercard, American Express, and Discover, or we can ship C.O.D.
Shipping:
We ship U.P.S., Parcel Post, Air and Ocean Freight. Priority shipments available. All items are F.O.B. our Warehouse or Factory Distributor.
Prices:
All prices subject to change without notice. Typographical or similar errors subject to correction.
Quotations:
Quotations are valid for 30 days.
Damaged, Lost or Stolen Shipments:
Truck-- If your shipment is damaged or short one or more packages, you must make a note on the shipping receipt before signing. Please do not accept a short or damaged shipment without proper notification to the truck driver. U.P.S.-- If a U.P.S. shipment is damaged or short one or more packages, please call us immediately so we can reship the items and place a claim. You must keep the damaged goods and all shipping materials for U.P.S. inspection.
Claims:
All claims must be made within 5 days of receipt. Damages incurred in commercial shipments must be claimed through the common carrier.
Returned Goods:
All returned merchandise must be unused and in original condition, and accompanied by return slip or original shipper. Returned merchandised due to customer error must be prepaid and subject to restocking charges. Special order merchandise, or merchandise held by customer for over 30 days, will not be accepted for return.
Warranty:
As the seller we make no warranties, expressed or implied, of performance, merchantability, workmanship, fitness, quality, durability or suitability of the merchandise in any respect including its fitness for the purpose and the uses of the buyer. The only warranties applying to merchandise sold are those specifically provided by the manufacturer. Seller further makes no expressed warranties or implied warranties of merchantability or fitness with respect to any changes, alterations or modifications made in materials at the request or instruction of the purchaser. The obligations of the seller are limited to repair or replacement of defective parts or, at its sole option, to refund of the purchase price. Seller is not liable for incidental or consequential damages. We do not warrant or represent that the merchandise complies with the provisions of any law, particularly including the Walsh-Healy Public Contracts Act and the Occupational Safety and Health act of 1970, and the regulations promulgated thereunder, unless the manufacturer so warrants. This warranty is in lieu of all other warranties, expressed or implied, including any implied warranty of merchantability or fitness for a particular purpose. In no event shall Small Tools Inc., be liable for any special, incidental or consequential damages (including, but not limited to, lost profits.)
